Introduction
Welcome to LearnHaus LLC ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of our online K–12 tutoring platform, website, and any materials provided by us (collectively, the "Services"). By using the Services, you agree to these Terms. This page is informational and not legal advice.
What We Offer
LearnHaus LLC is an online-only K–12 tutoring membership service for US families. We provide:
- **One-on-one online tutoring sessions** conducted via video conferencing (Zoom)
- **Hand-matched tutor assignments** based on student needs, grade level, subjects, and schedule
- **Monthly membership subscriptions** with hour credits that roll over month-to-month
- **Session summaries** provided after each tutoring session to track student progress
- **Flexible scheduling** managed through our platform
All services are provided online only. We do not offer in-person tutoring services.
Accounts, Roles, and Responsibilities
Parents/Guardians
- Are the customer of record and control the family account
- Manage membership subscriptions, payments, and billing
- Approve tutor assignments and student-initiated bookings
- Have full visibility into session history and hour ledger balances
- Are responsible for ensuring students comply with these Terms
Students
- Are minors using the Services under parental authorization and oversight
- Can schedule and confirm sessions (subject to parent approval for student-initiated bookings)
- Must confirm sessions at least 6 hours before the scheduled start time
- Are expected to attend sessions on time and engage respectfully with tutors
Tutors
- Are independent contractor providers (1099), not employees of LearnHaus LLC
- Complete background checks and verification before being matched with families
- Are paid through our payment partners (Stripe Connect) based on completed sessions
- Must confirm sessions at least 6 hours before the scheduled start time
- Are responsible for submitting session summaries within 48 hours of each session
- Are responsible for their own tax filings, tools, and compliance with applicable laws
Admins
- Manage the platform experience and enforcement of these Terms
- Handle tutor matching, support requests, and platform operations
Membership and Hours Bank
Membership Tiers
Parents may purchase one of three membership tiers:
- **RubyHaus** ($299/month): Approximately 4 hours per month. Ideal for 1 session per week in a single subject.
- **EmeraldHaus** ($579/month): Approximately 8 hours per month. Most popular for 2–3 sessions per week across one or two subjects.
- **DiamondHaus** ($799/month): Approximately 12 hours per month. Best for high-frequency support across multiple subjects or siblings.
Hour Credits and Ledger
- Monthly hour credits are added to your family's hour ledger at the start of each billing cycle
- Unused hours roll over month-to-month (no expiration)
- When you book a session, we place a **HOLD** equal to the scheduled minutes
- Your **available balance** = credits - debits - holds - penalties
- After a session ends, the HOLD typically converts to a **DEBIT** within 12 hours unless the session was canceled per policy
- Canceled sessions may return some or all hours depending on timing and membership tier (see "Cancellations & No-Shows" below)
Cancellation and Refunds
You may cancel your membership at any time. Cancellation takes effect at the end of your current billing period. You retain access to your hour credits until the end of the billing period. Membership fees are generally nonrefundable except as required by law. See our "Refunds & Cancellations" policy for details.
Payments and Billing
- Payments are processed securely by Stripe
- By making a purchase, you authorize Stripe to charge your selected payment method for membership fees and any applicable taxes
- We do not store full credit card numbers on our systems
- You agree to maintain valid payment information
- Failed payments may result in suspension of Services until payment is resolved
- Prices are subject to change with 30 days' notice to existing subscribers
Scheduling, Confirmations, and Changes
Session Scheduling
- Sessions can be scheduled by Parents, Students (with parent approval), or Tutors (with parent approval)
- Student- and Tutor-initiated bookings require Parent approval within a 15-minute window or the booking is automatically canceled
- Sessions can be scheduled in 30, 60, 90, or 120-minute increments
Confirmations
- Both the Tutor and Student must confirm sessions at least **6 hours before** the scheduled start time
- If either party fails to confirm by the deadline, the session may be automatically canceled and the HOLD released
- Changing session time or details resets confirmations, requiring both parties to reconfirm
Session Changes
- Session times can be modified up to the confirmation deadline
- Any time change resets confirmations
- The platform may cancel or reschedule sessions in limited cases (safety concerns, repeated non-payment, or operational constraints)
Cancellations & No-Shows
Late Cancellation Penalties
If both the Tutor and the parent/student have confirmed a session, late cancellations may result in a partial deduction of scheduled minutes from your membership hour bank. Penalties depend on your membership tier and timing:
- **RubyHaus**: Canceling less than 24 hours before start time = **50% penalty** (half the session minutes deducted)
- **EmeraldHaus**: Canceling less than 12 hours before start time = **50% penalty** (half the session minutes deducted)
- **DiamondHaus**: Canceling less than 3 hours before start time = **25% penalty** (quarter of the session minutes deducted)
**Important**: If either party has not confirmed the session, no cancellation penalty is applied to the parent's hour bank.
No-Shows
If a participant fails to attend a confirmed session without timely cancellation, **100% of the scheduled minutes** are deducted from the parent's hour bank (regardless of tier). This is treated as a used session.
Tutor Cancellations
If the Tutor cancels or fails to appear, the parent's hour bank is **not penalized**. Hours are returned to the account, and the session can be rescheduled at no cost to the family.

Conduct and Acceptable Use
You agree to use the Services in a respectful, lawful manner. Prohibited behavior includes:
- Harassing, threatening, or exploiting others
- Attempting to bypass security controls or misuse the platform
- Sharing account credentials or allowing unauthorized access
- Using the Services for any illegal purpose
- Recording sessions without explicit consent from all participants
- Soliciting tutors or families to work outside the platform (see "Non-Circumvention" below)

Tutors as Independent Contractors
Tutors are independent contractors, not employees of LearnHaus LLC. This means:
- Tutors are responsible for their own tax filings and compliance
- Tutors provide their own equipment and tools
- Tutors set their own availability within the platform
- Tutor payouts are facilitated by our payment partners (Stripe Connect)
- LearnHaus LLC does not control how tutors deliver instruction, only that they meet platform standards
Non-Circumvention
You agree not to circumvent LearnHaus LLC by engaging tutors outside the platform for substantially similar services during an active engagement and for a reasonable period (12 months) thereafter. This protects the matching and platform infrastructure that enables our Services.
Recordings and Consent
Sessions may be recorded for quality assurance, safety, and training purposes. All participants must provide explicit consent before recording begins, as described in our Recording Consent policy. Recordings, if any, are used consistent with our Privacy Policy and are not shared publicly.
Privacy and Data
We process personal information as described in our Privacy Policy, including:
- California privacy disclosures (CCPA/CPRA compliance)
- COPPA compliance for children under 13
- Data retention policies
- Your rights to access, delete, or correct your information

SMS Messaging Program
If you opt in, LearnHaus may send automated SMS about tutoring sessions (confirmations, reminders, join links, and session updates).
Message frequency varies. Msg & data rates may apply.
To opt out, reply STOP. For help, reply HELP or email support@learnhaus.net.
Consent is not a condition of purchase or service.
Carriers are not liable for delayed or undelivered messages.
Technology and Third-Party Services
Our Services rely on trusted third-party providers:
- **Zoom**: Video conferencing for tutoring sessions
- **Stripe**: Payment processing and subscription management
- **Supabase**: Database, authentication, and backend infrastructure
- **Postmark**: Transactional email delivery
- **Sentry**: Error monitoring and performance tracking
We do not sell your personal data. These providers process data under their own terms and privacy policies, and we share only the minimum necessary information to deliver the Services.
Intellectual Property
- Content provided by LearnHaus LLC (including session summaries, platform features, and materials) is owned by LearnHaus LLC or its licensors
- You retain ownership of content you create or upload
- By using the Services, you grant LearnHaus LLC a license to use your content to provide and improve the Services
Disclaimers
To the fullest extent permitted by law, the Services are provided "as is" without warranties of any kind, express or implied. We do not guarantee:
- Specific academic outcomes or grade improvements
- Tutor availability or specific tutor assignments
- Uninterrupted or error-free service
- Compatibility with all devices or internet connections
Limitation of Liability
To the fullest extent permitted by law, LearnHaus LLC will not be liable for:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenues, data, or business opportunities
- Damages exceeding the amount you paid to us in the 12 months preceding the claim
This limitation does not apply to damages caused by our gross negligence or willful misconduct.
Indemnification
You agree to indemnify and hold harmless LearnHaus LLC from any claims, damages, or expenses arising from:
- Your use of the Services
- Your violation of these Terms
- Your violation of any third-party rights
- Content you submit or transmit through the Services
Governing Law and Dispute Resolution
These Terms are governed by the laws of Florida, USA, without regard to conflict of law principles.
Arbitration
Any dispute arising from or relating to these Terms will be resolved by binding arbitration in Manatee County, Florida, except that either party may seek injunctive relief in a court of competent jurisdiction. Arbitration will be conducted under the rules of the American Arbitration Association.
Class Action Waiver
You agree to resolve disputes individually and waive any right to participate in class actions or representative proceedings.
Updates to These Terms
We may update these Terms from time to time to reflect changes in our Services or legal requirements. The "Last updated" date reflects the most recent changes. Material changes will be announced through the Services or by email at least 30 days before they take effect. Your continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
